The & is only required in the source HTML fed to a browser. The browser
will convert it into & when it renders the page. Via any other route, it
should also be &, because it isn't arriving as HTML.
The bottom line is, the Validator is correct. And also that when launching
URLs in HTML mode, maybe StrongED should be able to fudge any entities that
it encounters...
